DHS proposed visa rule exempts most physicians and dentists

The Department of Homeland Security (DHS) recently released a proposed rule that would impose a $103,265 fee on employers sponsoring H-1B visa workers; however, the proposed rule excludes “cap-exempt H-1B petitions,” which are typically used to sponsor internationally born physicians and dentists. Therefore, the new fee should not apply to most internationally born physicians and dentists who are in the U.S. or would traditionally come to the U.S. on an H-1B visa.

President Trump tried to impose a fee last year via proclamation that would apply to physicians and dentists. The fee was halted pending legal challenges. AAOMS, along with other organizations representing healthcare professionals, commented against the fee and also supported the Physicians and Healthcare Workforce Act (HR 7961), which would exempt physicians, dentists and other healthcare workers from the fee and prevent future H-1B fees beyond those currently authorized by federal law.
